Action Audit End User Terms

1. Introduction

These End User Terms (hereinafter: "Terms") set out the rules for using the Action Audit system by individuals holding a user account (hereinafter: "User").

The Action Audit system is provided by Ruby Logic Poland Sp. z o.o., with its registered office in Bielsko-Biała (43-300), ul. Aleksandrowicka 35, Poland, KRS: 0000933511, Tax ID (NIP): 5472228121 (hereinafter: "Provider").

Upon first login to the System, the following is required:
- acceptance of these Terms (checkbox),
- acknowledgement of the Action Audit Service Privacy Policy (separate checkbox).


2. Your Account

  1. Your account in the Action Audit System (hereinafter: "Account") was created at the request of your employer or principal (hereinafter: "Company"), which has entered into an agreement with the Provider for the use of the System or is using the Evaluation Period (trial).

  2. You use the System on behalf of and for the benefit of the Company. The main agreement governing the use of the System has been concluded between the Company and the Provider — these Terms supplement it insofar as they relate to you as a User.

  3. Your Account is identified by:

    • e-mail address (Action Audit Platform),
    • mobile phone number (Action Audit Mobile Application).

3. Rules of Use

3.1 Permitted Use

You may use the System solely for purposes related to your work or cooperation with the Company, in accordance with the intended purpose of the System.

3.2 Your Obligations

As a User, you undertake to:

  • a) protect your login credentials — your password is confidential; do not share it with anyone, including your supervisors,
  • b) immediately report incidents — if you suspect unauthorised access to your Account or any security breach, immediately inform the Company's administrator and the Provider ([email protected]),
  • c) use up-to-date software — use current versions of the browser or mobile application,
  • d) comply with the Company's internal policies regarding the use of IT systems.

3.3 Prohibited Activities

You must not:

  • a) share your Account with other persons (temporarily or permanently),
  • b) attempt to gain access to other Users' accounts or other companies' data,
  • c) attempt reverse engineering, decompilation, or circumvention of the System's security measures,
  • d) introduce into the System any content that is illegal, offensive, or infringing upon the rights of third parties,
  • e) use the System for purposes unrelated to your work or cooperation with the Company,
  • f) excessively burden the System in a manner exceeding normal use.

4. Content in the System

  1. Data, documents, and content that you enter into the System constitute the property of the Company (or of third parties, as applicable under the law).

  2. By entering content into the System, you confirm that you are authorised to do so within the scope of your duties towards the Company.

  3. The Provider does not monitor or verify content entered by Users, unless this is necessary for technical or security reasons.


5. Personal Data Protection

5.1 Who Is the Controller of Your Data

  • The Provider (Ruby Logic) is the controller of your account data (first name, surname, e-mail, phone number) — we process them for the purpose of maintaining your Account and providing the Service.
  • The Company is the controller of the content you enter into the System — Ruby Logic processes it solely on the Company's instructions as a data processor.

5.2 Your Rights

With respect to Ruby Logic (as the controller of account data), you are entitled to the following rights under the GDPR:

  • the right of access to data and to receive a copy thereof,
  • the right to rectification of data,
  • the right to erasure of data (subject to exceptions),
  • the right to restriction of processing,
  • the right to data portability,
  • the right to object,
  • the right to lodge a complaint with the President of the Personal Data Protection Office (UODO).

Regarding content in the System (of which the Company is the controller), please direct your requests to your Company.

6. Security

  1. The Provider applies technical and organisational measures ensuring data protection in accordance with the ISO/IEC 27001:2022 standard, including encryption, access control, monitoring, and backups.

  2. The security of the System also depends on you — please follow the rules described in Section 3.2.


7. Availability and Changes

  1. The System is provided in its current version (as-is). The Provider continuously develops the System's features.
  2. The Provider reserves the right to modify the System's features without prior notice to Users.
  3. The Provider will give at least 48 hours' notice of planned maintenance windows.

8. Termination of Use

  1. Your Account may be deactivated by:

    • a) the Company's administrator — at any time (e.g. in connection with a change of position or termination of cooperation with the Company),
    • b) the Provider — in the event of a breach of these Terms or termination of the agreement between the Company and the Provider.
  2. Upon deactivation of your Account, you will lose access to the System. Data associated with your Account will be processed in accordance with the Privacy Policy and the agreement between the Company and the Provider.


9. Liability

  1. The Provider shall not be liable for damages arising from:

    • a) your disclosure of login credentials to third parties,
    • b) use of the System in a manner inconsistent with these Terms,
    • c) content entered by you into the System.
  2. Detailed liability provisions governing the Provider's liability towards the Company are set out in the agreement between the Company and the Provider.


10. Final Provisions

  1. These Terms are governed by Polish law.
  2. The Provider reserves the right to amend these Terms. You will be informed of any changes upon your next login to the System.
  3. Continued use of the System after being notified of changes and accepting the new version constitutes acceptance thereof.

11. Language Version

The original language of these Terms is Polish. In the event of discrepancies between language versions, the Polish version shall prevail, unless mandatory provisions of law provide otherwise.
